Event Terms and Conditions

The Master Builders Association of Victoria Pty Ltd (ACN 004 255 654).

These Event Terms and Conditions (“Terms”) apply to The Master Builders Association of Victoria (ABN 38 004 255 654) (MBV), any other related entity and any Event Attendee.

Please read these Terms carefully as they contain important information. You acknowledge that you have read and agree to be bound by these Terms upon submitting your Registration to MBV.

Definitions

Attendee;Attendee means a person who participates in the Event. In these Terms, a reference to “you” or “your” is a reference to the Attendee.
Business Day;Business Day means a day that is not a Saturday, Sunday or a public holiday in Victoria
Consumer Guarantees;Provisions of the Competition and Consumer Act 2010 and other laws in force from time to time in Australia that may impose guarantees, warranties, conditions and obligations.
Event; Event means any webinar, face-to-face workshop, conference, networking event or any other occasion listed on this page: https://www.mbav.com.au/events  
Force Majeure;Any event beyond the control of the relevant party
Registration; Registration means signing up or enrolling and paying the related fee (if applicable) to attend an event organised by MBV. 

1. MBV’s rights

  • You acknowledge and accept that MBV may:
    – Change the format, location or timing of an Event.
    – Postpone the Event
    – Cancel the Event
  • If the Event is cancelled by MBV because of Force Majeure MBV will refund the fee paid by you minus any reasonable administration costs (if applicable).

2. Attendee rights and obligations

  • You must comply with the terms and conditions of entry to each venue connected with any Event you attend, and with any lawful directions given by its authorised personnel.
  • MBV reserves the right to refuse admission or remove you from an Event in its absolute discretion for reasons including, but not limited to, a failure to comply with the Terms or if your behaviour is inappropriate or unlawful.
  • MBV often undertakes or facilitates photography and/or video at our Events. You acknowledge that these images and footage may be used in future promotions including but not limited to website, direct mail, marketing collateral, email, sales documents and other uses by MBV. By attending the Event you agree to this as a condition of entry.

3. Cancellation

  • If you are unable to attend an Event, you must send written notice to ev****@mb**.au at least 2 Business Days prior to the Event starting. Any cancellations received within 2 Business Days of the Event will not receive a refund.
  • No refunds will be given for any non-attendance of an Event.
  • Any refund (if applicable) will be made via the same payment method as the original receipt of funds.

4. Limitation of liability and indemnity

  • Subject to any Consumer Guarantees and the maximum extent permitted by law, MBV, its employees, officers, directors and contractors will not be liable for personal injury or death, losses, damage, expenses or penalties that you may incur or suffer arising out of, or in connection with, the Event.
  • You agree to full indemnify MBV (and its employees, directors, officers and agents) from any claim, cost, losses demand, liability or damage incurred by MBV arising in connection with the Event, including but not limited to:
    – Any failure by you to comply with these Terms
    – Any failure by you to comply with any legislative/regulatory requirement
    – Any negligent act, wrongful conduct or omission by you
    – Any damage you cause to the venue

5. Privacy

  • Registration information and other information about you is subject to our Privacy Policy, which can be found on our website. You understand that through your use of the website you consent to the collection and use (as set forth in the Privacy Policy) of this information.
  • You consent to MBV collecting and storing your personal information including all the information contained in the registration form, for the purposes of administering and managing the Event. This may include MBV sharing your information with all relevant suppliers and third parties involved in the delivery of the Event.
  • This may also include sharing your organisation’s information to other Event participants and sponsors.

6. General

  • MBV may revise these Terms from time to time by updating this page. The revised Terms will take effect when they are updated.
  • These Terms are governed by and construed in accordance with the laws in the State of Victoria.
